TERMS OF SALE

 

ARTICLE 1 – FIELD OF APPLICATION

These terms and conditions which constitute the basis of commercial negotiations can not be canceled or changed whatever the terms may appear on the records of the buyer, including its general purchasing conditions on which these Terms and Conditions Sales prevail.

 

ARTICLE 2 - PRICE

2.1 - The prices of our products are in US Dollars.
2.2 - All orders, regardless of their origin, are payable in US Dollars.
2.3 - Airsoft Diffusion reserves the right to change prices at any time in case of strong fluctuation of the dollar or commodities. The products are billed on the basis of rates in effect at the time of order entry subject to availability.
2.4 - In case you order, you are the importer of the product concerned. Customs duties or other local taxes are likely to be due. These rights are not within the jurisdiction of Airsoft Diffusion. They are charged to the customer and are entirely his responsibility in terms of statement of payment to the authorities of the country of delivery. We advise you about these issues with your local authorities.

 

ARTICLE 3 - ORDER

3.1 - Airsoft Diffusion reserves the right to refuse any order from a customer with whom there is a dispute over payment of a previous order. Any order implies acceptance of the prices and descriptions of products available for sale.
3.2 - The information given by the buyer when the order is taken, commit this: if error in the address of the recipient, Airsoft Diffusion can not be held responsible for failure in which it could be deliver the product.

 

ARTICLE 4 – AVAILABILITY OF ITEMS

Our products are available within the limits of available stock.
If, despite our vigilance products prove unavailable after placing your order, we will notify you as soon as possible. You can then request the cancellation of your order.

 

ARTICLE 5 -DELIVERY

The products are delivered to the shipping address you provided when ordering. The delivery comprises the product ordered, packaged and itemized bill. Delivery times are 4-6 days (worked) to the receipt of your payment by paypal. The times indicated are average times and correspond to the time of processing and delivery. They are not absolute deadlines.
Airsoft Diffusion can not be held liable in case of late delivery or out of stock.

The customer is responsible for checking the condition of the goods on delivery and make reservations with the carrier upon receipt of a damaged package by mentioning it on the delivery of the carrier and reporting it to Airsoft Diffusion, within 72 hours (worked). After this time, delivery and products are deemed compliant and free of defects. In case of defect or non-compliance of the products delivered, duly noted by Airsoft Diffusion, the customer can get free replacement or refund of products, choice of Airsoft Diffusion, excluding any compensation or damages.

 

ARTICLE 6 - PAYMENT

We only accept payment by Paypal.
Your order will be processed upon receipt of your payment corresponding to the totality of your order subject to an invoice.

 

ARTICLE 7 – RETURN OF GOODS

7.1 Terms
Any product return must be a formal agreement between the seller and the buyer. Any product returned without this agreement shall be kept available to the purchaser and not give rise to the establishment of an asset. The costs and risks are still borne by the purchaser.
7.2 Consequences
Of course, the item must be new and not being used. It is simply asking for it back in its original packaging, along with a copy of the invoice, and indicate the reason for return.

ARTICLE 8 - GARANTY

Items are guaranteed 6 months from the date of invoice, against defects in materials or workmanship. The invoice and / or purchase order is a guarantee. A copy must necessarily be attached when returning an item. Airsoft Diffusion examine the returned product and, if the customer's complaint is opened by this contract security, Airsoft Diffusion pledges to restore functioning or replacement charge if the product is not repairable.
Finally, the contractual guarantee does not apply in case of improper use or modification of the product in the event of willful damage the client, if the product has suffered external damage such as drop, shock, fire, etc. ... 

ARTICLE 9 – RESERVATION OF OWNERSHIP

Airsoft Diffusion retains ownership of products until the actual payment of the full price in principal and accessory.
This retention of title does not preclude the transfer of risk to the customer upon delivery of products. Consequently, delivery, products are placed under the responsibility of the customer who bears all risks of loss and damage and agrees that any insurance as useful.
By express agreement, may play Airsoft Diffusion the rights it holds under this reservation of ownership for any of its claims on all its products in the possession of the customer, the latter being conventionally assumed be those unpaid, and Airsoft Diffusion may recover or claim for compensation of all those unpaid bills, without prejudice to its right to cancel pending sales.

 

ARTICLES 10 – INTELLECTUAL PROPERTY

All items displayed in our catalog (logos, trademarks) belong to their respective owners.

 

ARTICLE 11 - RESPONSABILITY

11.1 – Airsoft Diffusion company can not be held liable for damages of any kind, either bodily or material that could result from the misuse of items sold.
11.2 - The photographs and texts and illustrating the products presented are not contractual. Airsoft Diffusion is not responsible for any error in one of these photographs or one of these texts.
